What is the limitation for filing a complaint if the notice under?

Notice must be sent no later than 30 days from the day on which the cheque was returned. If after 15 days from the date of receipt of the notice, the defaulter does not redeem or honor the cheque or pay the proceeds, then the Complainant must file complaint at magistrate court no later than 30 days from the 16th day. Cheque has to be deposited for clearing no later than 90 days from the date on the cheque. LImitations to 138 NI Act - can be flexible slightly under Section 142 NI Act. The magistrate may allow 510 days or even upto 30 days delay in filing the case but no later.
